Judicial Panel to Reconsider Ruling That Permitted Trump to Deploy Military Forces to Portland

The federal appeals court has upheld a prohibition on sending state troops in Portland, Oregon, after a latest legal decision.

Appeals Court Agrees to Rehear Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would rehear the legal dispute concerning the president’s authority with an expanded panel of 11 judges. The court also overturned a earlier ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the latest turn in a protracted court case over whether the former president has the legal right and justification to send state military units in Portland. Approximately 200 federalized guard members have been in limbo since late September when the mobilization attempt was initiated in response to months of protests.

Conflicting Arguments

The administration has argued that government employees at the immigration center in the southern part of the city were facing threats, while city and state officials assert that municipal police have control of the situation.

Contrary to descriptions of the city as “war ravaged”, residents have been posting videos of lush hiking trails and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a federal judge in the city issued two temporary restraining orders this month – one blocking the federal control of the state troops, and another prohibiting the deployment of any military personnel in Oregon, after efforts to evade the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of 200 Oregon national guard – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

The latest ruling means the matter will be heard by the full court – with both rulings under consideration together – by a panel of 11 judges.

“This ruling demonstrates that the truth matters and that the judicial system are working to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a official comment.

“The court is sending a clear message: the president cannot dispatch the military into US cities unnecessarily. We will continue defending state legislation, values, and sovereignty as this case moves forward and our fight continues in the courts.”
